Man Shot In Hand During Dispute Over Condo; Shooter Arrested

MAN SHOT IN HAND DURING DISPUTE OVER CONDO; SHOOTER ARRESTED

An Ormond Beach condo owner is in custody today after a Monday evening dispute with a tenant that resulted in a gunshot wound to the tenant’s hand.

Deputies first showed up at the condominium at 1510 Ocean Shore Blvd. around 4:41 p.m. Monday in response to a complaint from the owner, 60-year-old Gary W. Moore (DOB 3/23/1957), about his tenant. Moore said he agreed to let the tenant, 39-year-old Jorge Martinez, live in the condo if he helped renovate it.

Moore decided on Monday that Martinez wasn’t holding up his end of the bargain anymore and wanted him out. Deputies advised Moore that if Jorge had previously completed some work per their agreement, he had to be removed through the civil eviction process. However, Moore placed all of Martinez’s property outside the front door and slammed it shut.

Later, around 6:32 p.m., a deputy was back at the condo because Martinez’s dogs were loose. The deputy helped round up the dogs and met with Martinez, who said he was paid up to stay in the condo until the end of the month. A deputy advised him that the issue was a civil matter, and to contact the Sheriff’s Office if he needed assistance. But as the deputy was leaving, he saw Martinez break a window next to the condo’s front door. The next thing the deputy heard was a gunshot. The deputy yelled at Martinez to come to him, and he saw that the gunshot wound was to Martinez’s left hand.

Deputies and Ormond Beach police set up a perimeter at the condo, and after a short time, Moore came outside peacefully.

After an investigation, Moore was charged with aggravated battery with a deadly weapon and possession of a firearm by a convicted felon. Moore had a 1978 felony conviction for aggravated assault with a deadly weapon in Texas. He remained held Tuesday morning on $20,000 bond.

Martinez was transported to Halifax Health Medical Center in Daytona Beach for treatment of his non-life-threatening injuries.
