One shot in altercation at DeLand-area gas station

One person was shot this evening during an altercation at the Circle K at International Speedway Boulevard and Kepler Road, DeLand. Deputies responded to the call around 6:45 p.m. The shooter remained on scene. The injured shooting victim was transported to the hospital. A full investigation is underway and more information will be posted as it becomes available.

CASE UPDATE: Detectives are continuing to investigate this case. The shooter is 21-year-old male from DeLeon Springs, and the injured is a 62-year-old male from DeLand. Interviews and video footage indicate the two men were involved in an argument at a gas pump. The altercation turned physical, and the shooter ultimately fired one shot into the other man's leg. The shooter told detectives he felt threatened, did not want to kill the man, and only fired a shot into his leg to stop the situation from escalating further. The injured party was stable at the hospital following the incident. No charges have been filed at this time.

CASE UPDATE #2: After a thorough investigation and consultation with the State Attorney's Office, the shooter in this incident has been charged with one count of aggravated battery with a firearm.

Through a review of witness statements, interviews of the parties involved, surveillance video, and 911 audio, it was determined that the actions of Jonathan Martinez (21, DeLeon Springs) did not meet the criteria for lawful self defense using deadly force.

During the argument and ensuing altercation over a gas pump, the shooting victim (62, DeLand) was unarmed, repeatedly raised his empty hands, and at several points disengaged and walked away. Martinez armed himself early in the encounter, advanced with a raised firearm on multiple occasions, and initiated physical contact by shoving the victim while holding the weapon. The victim's actions did not present an imminent threat of death or great bodily harm that would justify the use of deadly force under Florida law.

Martinez was arrested without incident today (Wednesday) at his home and taken to the Volusia County Branch Jail with no bond pending first appearance.
