The identity of the deceased is Jose Guillermo Flores Colon, 37 (DOB 7/28/1979). The deputy who fired his weapon is Shawn Adkins, 26, hire date: Oct. 5, 2015. The incident report and 911 call associated with this incident are available on request.

MAN FATALLY SHOT AFTER GRABBING VCSO DEPUTY’S TASER

A man was shot late Thursday afternoon by a Volusia County sheriff’s deputy after he struggled with two deputies responding to a call about strange behavior in a gas-station bathroom. The man, who grabbed one deputy’s Taser just before he was shot – died at the scene.

The deputies involved weren’t injured in the incident at the RaceTrac station at 2001 Saxon Blvd. in Deltona.

Deputies were dispatched to the RaceTrac after the Sheriff’s Office received a 911 call at 4:13 p.m. reporting a suspicious man who was in the store’s bathroom for nearly 90 minutes, running around shirtless.

The first deputy arrived at the scene at 4:19 p.m. and encountered the man in the bathroom, along with drug paraphernalia on the sink. The deputy attempted to calm him down and take him into custody. However, before the first deputy and a second arriving deputy could secure him, the man managed to gain control of the second deputy’s Taser. In response to the immediate threat posed by the now-armed subject, that deputy pulled his duty weapon and fired.

The identity of the deceased will be released in a future update, as will the name of the deputy who fired.

The Florida Department of Law Enforcement will investigate the shooting, which is standard practice in deputy-involved shootings. The deputy who fired his weapon is being temporarily placed on administrative leave with pay, also standard practice.
