UPDATE: Suspect Indicted On First-Degree Murder Charge In Overdose Death

A grand jury has indicted 37-year-old Milton Marrero (DOB 7/17/1982) of Deltona on a charge of first-degree murder in the April overdose death of Mark Guerin Jr.

Marrero was indicted on Monday and was already in custody at the Volusia County Branch Jail, where detectives arrested him on his murder charge.

Guerin was found dead on April 5 along Lake Helen Osteen Road, and it was later determined he died as a result of an overdose on fentanyl.

Volusia sheriff’s deputies have arrested Marrero multiple times, including an arrest after a traffic stop in November 2018, when a deputy found him in possession of a trafficking amount of heroin, small plastic baggies, multiple used syringes and a loaded firearm. He was later released on bond, then arrested again April 23 of this year (about 3 weeks after Guerin’s death) after another traffic stop, and again on May 29 after his bond was revoked.

This case is the fifth murder indictment that the Volusia Sheriff’s Office has obtained in an overdose death investigation since 2017. The other four are:

  • Sergio Perez, 43 (DOB 4/24/1975), Deltona, indicted April 22 on one count of first-degree murder in the death of Joshua Lacy.
     
  • Melanie Cunningham, 27 (DOB 5/23/1991), Deltona, indicted April 22 on two counts of 1st-degree murder in the deaths of Joshua Lacy and Heather McCurdy.
     
  • Hunter Romaine, 25 (DOB 9/19/1994), DeBary, indicted Sept. 5, 2018, on one count of first-degree murder in the death of Ashley Barrett. Romaine later pleaded no contest to manslaughter and was sentenced to 5 years in prison.
     
  • Steve Montilla, 33 (DOB 5/15/1986), Sanford, indicted June 25, 2018, on one count of first-degree murder in the death of Jacqueline Griggs. Montilla later pleaded no contest to manslaughter and was sentenced to 15 years in prison.

*Update 4/5/19* 

The deceased is Mark Guerin Jr., 35 (DOB 2/14/1984). He was pronounced dead on scene at 4:59 a.m. There were no signs of trauma or any immediate indications of foul play causing his death. Toxicology test results are pending to determine Guerin’s cause of death.

VCSO INVESTIGATING AFTER MAN FOUND DEAD ALONG LAKE HELEN OSTEEN ROAD IN DELTONA

Volusia County sheriff’s detectives are on the scene of a death investigation at 2308 Lake Helen Osteen Road, Deltona.

Deputies responded to that address after a call around 4:35 a.m. about an unresponsive adult male lying on the ground near the road.

The investigation is active and no other details are available for release at this time, but updates will be provided as they become available.
